By using the Website we assume you have the right, authority, and capacity to enter into this Agreement and to abide by all of the terms and conditions of this Agreement. Thus, AFICIONADUS reserves the right to close any account that does not fulfill these terms.

This Agreement is to be seen as whole and one and sets out the legally binding terms of your use of the Website, your membership in the service and may be modified by AFICIONADUS at any time and without prior notice. Such modifications to be effective upon posting by AFICIONADUS on the Website and indicate the date these terms were last revised. Your continued use of the Service or the Website after any such changes constitutes your acceptance of the new Terms of Use. If you do not agree to abide by these or any future Terms of Use, do not use or access (or continue to use or access) the Services. It is your responsibility to regularly check the Website to determine if there have been changes to these Terms of Use and to review such changes.

This Agreement, accepted upon use of the Web site and Services and further affirmed by becoming a Member, contains the entire agreement between you and AFICIONADUS regarding the use of the Web site and/or the Service. The failure of AFICIONADUS to exercise or enforce any right or provision of these Terms of Use shall not constitute a waiver of such right or provision. If any provision of this Agreement is held invalid, the remainder of this Agreement shall continue in full force and effect. Please contact us with any questions regarding this agreement.

This Agreement will remain in full force and effect while you use the Web site, access and use our services and/or are a Member. For any reason, you are free to terminate your membership at any time by following the instructions on the Cancel/Delete Account page in Account Settings. Then the terms will no longer be applied to the Member. You understand and agree that the cancellation of Member's account is Member's sole right and remedy with respect to any dispute with AFICIONADUS. AFICIONADUS may terminate your membership for any reason, at any time without notice. If AFICIONADUS terminates your membership in the Service because you have breached the Agreement, you will not be entitled to any refund of fees should and /or payments. If you were previously banned from AFICIONADUS you are not eligible to create another account and become once more a user of AFICIONADUS Services.

You agree that any kind of translation to other language than Portuguese of this Agreement or any other document is only a means to provide them for your own convenience, thus, the documents that hold binding to you and AFICIONADUS are the ones in Portuguese, the original ones.

Proprietary Rights in Content on AFICIONADUS

AFICIONADUS owns and retains all proprietary rights in the Web site and the Service. The Web site contains the copyrighted material, trademarks, and other proprietary information of AFICIONADUS, and its licensors. Except for that information which is in the public domain or for which you have been given written permission, you may not copy, modify, publish, transmit, distribute, perform, display, or sell any such proprietary information.

Illegal and/or unauthorized uses of the Web site, including collecting usernames and/or email addresses of members by electronic or other means for the purpose of sending unsolicited email and unauthorized framing of or linking to the Web site will be investigated, and appropriate legal action will be taken, including without limitation, civil, criminal, and injunctive redress.

You understand and agree that AFICIONADUS may review and delete any personal information or profiles that in the sole judgment of AFICIONADUS violate this Agreement or which might be offensive, illegal, or that might violate the rights, harm, or threaten the safety of Members.

You are exclusively responsible for the Content that you publish or display/post on the Service, or transmit to other Members. By posting Content to any public area of AFICIONADUS, you automatically grant, and you represent and warrant that you have the right to grant, to AFICIONADUS an irrevocable, perpetual, non-exclusive, fully paid, worldwide license to use, copy, perform, display, and distribute such information and content and to prepare derivative works of, or incorporate into other works, such information and content, and to grant and authorize sublicenses of the foregoing. AFICIONADUS reserves the right to investigate and take appropriate legal action in its sole discretion against anyone who violates this provision, including without limitation, removing the offending communication from the Service and terminating the membership of such violators. AFICIONADUS respects proprietary rights of others and advises you to do so accordingly. If you think you are being a victim of copyright infringement please contact us immediately.

You may not transmit any chain letters or junk email to other Members. Although AFICIONADUS cannot monitor the conduct of its Members off the Web site, it is also a violation of these rules to use any information obtained from the Service in order to harass, abuse, or harm another person, or in order to contact, advertise to, solicit, or sell to any Member without their prior explicit consent.

AFICIONADUS’ own design, name, brand, logo, along with other AFICIONADUS content is protected under copyright, trademark and other legal framework.

You must use the Service in a manner consistent with any and all applicable laws and regulations.

Disclaimer

AFICIONADUS claims no intellectual property rights over the material and information you provide to the Service. Your account and materials uploaded remain yours. You are legally responsible for all information uploaded, posted or stored through your use of the Services. You grant AFICIONADUS a worldwide, royalty-free, non-exclusive license to host and use the information in order to provide you with the Services. You agree not use the Services for any illegal purpose or in violation of any applicable local or international law. You are responsible for any information that may be lost or unrecoverable through your use of the Services. You must provide all required and appropriate warnings, information and disclosure.

AFICIONADUS does not control the Member Content posted via the Service and as such, does not guarantee the accuracy, integrity or quality of such content. AFICIONADUS is not responsible for the conduct of any user of the Web site or Member of the Service. Under no circumstances will AFICIONADUS be responsible for any loss or damage, including personal injury or death, resulting from anyone's use of the website and/or the services provided.

AFICIONADUS does not guarantee that the services it provides will work properly and without interruptions or errors and assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, user or Member communications. AFICIONADUS does not warrant that the website, its servers, or the information, content and services included on or otherwise made available to you through the site (or by emails sent from the website) are free of viruses or other harmful components.

Limitation on Liability

When permitted by law, AFICIONADUS and AFICIONADUS’s partners, suppliers and distributors, will not be responsible for lost profits, revenues, or data, financial losses or indirect, special, consequential, exemplary, or punitive damages.

To the extent permitted by law, the total liability of AFICIONADUS, and its partners, suppliers and distributors, for any claim under these terms, including for any implied warranties, is limited to the amount you paid us to use the services (if applicable or, if we choose, to supplying you the services again).

In all cases, AFICIONADUS, and its partners, suppliers and distributors, will not be liable for any loss or damage that is not reasonably foreseeable.

Disputes

If there is any dispute about or involving the Web site and/or the Service, by using the Web site, you agree that the dispute will be governed by the laws of Portugal without regard to its conflict of law provisions.

You are solely responsible and accountable by your interactions with other AFICIONADUS members. AFICIONADUS reserves the right, but has no obligation, to monitor disputes between members, as in you and other members.

Indemnity

You agree to indemnify and hold AFICIONADUS, its affiliates, officers, agents, directors, shareholders and other partners and employees, harmless from any loss, liability, claim, or demand, including reasonable attorney's fees, made by any third party due to or arising out of your use of the Service in violation of this Agreement and/or arising from a breach of this Agreement.

Service Fees

You acknowledge that AFICIONADUS reserves the right to charge for the Service and to change its fees from time to time in its discretion. If AFICIONADUS terminates your membership because you have breached the Agreement, you shall not be entitled to the refund of any unused portion of subscription fees.
